摘要 构建和完善多元化纠纷解决机制是加强和创新社会管理的必然要求,是转型期中国社会治理面对的重大政治和法律课题。目前,我国已有的过分强调以诉讼方式解决纠纷的机制已经不能适应多元化社会发展的要求,为此,应当进一步明确人民调解的职能定位,逐步扩大人民调解的工作范围;正确定位行政机关在纠纷解决中的特殊职能,提升行政机关处理社会矛盾纠纷的主动性;同时,还应当积极构建沟通协调不同纠纷解决方式的有效平台,从而使绝大多数矛盾纠纷能够化解在基层,化解在初始状态。 Build and improve the dispute resolution mechanism is to enhance diversity and innovation necessary requirement for social management,management of Chinese society in transition face major political and legal issues.At present,China has over-emphasis on litigation for dispute resolution mechanisms have been unable to meet the requirements of the development of a pluralistic society.To this end,should further clarify the functions of people's mediation orientation,and gradually expand the scope of people's mediation work;Correct positioning of the executive authorities in dispute resolution in the special functions to enhance the executive's initiative to address social conflicts and disputes;At the same time,communication and coordination should also be actively build an effective dispute resolution in different platforms,so that the vast majority of conflicts and disputes can be resolved at the grassroots level,to resolve the initial state.
