碳关税的法律解读与中国的立场

LEGAL INTERPRETATION OF CARBON TARIFFS AND CHINA'S STAND ON THE ISSUE

2009年6月22日美国众议院通过《美国清洁能源安全法案》,该法案规定,美国有权对包括中国在内的不实施碳减排限额国家进口产品征收碳关税。该法案有关碳关税的规定,违背了WTO及《京都议定书》所确立的关税减让、国民待遇、共同但有区别的责任、最惠国待遇诸原则,并与GATT相关条款冲突。针对美国的做法,我国应坚持WTO及《京都议定书》所确立的原则,维护我国在国际贸易中的正当利益,同时加大低碳技术的研发力度,完善相关法律制度,大力发展低碳经济。

Carbon tariffs are charges for carbon dioxide emissions imposed on high energy consuming products.At present,it is the U.S.that,through American Clean Energy Security Bill passed by the House of Representatives,imposes tariffs on imported products from developing countries represented by China,which do not assume the obligation of compulsory carbon emission reduction according to Kyoto Protocol.This discriminatory behavior is against the 'common but differentiated responsibilities principles' by Kyoto Protocol,as well as the basic principles under the system of WTO.Most of its commodities being exported to America,China must hold the fort in accordance with the relevant principles and treaties on the one hand.And on the other hand,China should also further its development of low carbon technologies and quicken its steps to a low carbon economy.
