《全面推进依法行政实施纲要》诚信原则文本研究

TEXT STUDY OF HONESTY PRINCIPLE EMBODIED IN OUTLINE FOR PROMOTING LAW BASED ADMINISTRATION IN AN ALL ROUND WAY

2004年国务院《全面推进依法行政实施纲要》(以下简称《纲要》)的颁布,对中国建设法治政府的目标要求、方式步骤都作了明确而具体的规定。《纲要》及其配套规范性文件的出台,为各级政府及其部门依法行政提供了行为准则。诚信原则作为依法行政原则重要内涵之一,体现在《纲要》第三部分关于"依法行政基本要求"的相关规定当中。诚信行政是树立政府权威的关键,同时也是法治政府建设的重要环节。正确理解《纲要》关于诚信原则的规定,是实现依法行政目标的前提要求。《纲要》文本中的两个"行政决定"具有不同的内涵,其有关行政机关撤销、撤回、变更行政决定所要求的事由各不相同。《纲要》作为规范性文件应与其上位法——《行政许可法》保持一致。

Outline for Promoting Law based Administration in an All round Way issued in 2004 gives a clear statement about the goal and steps of constructing a government implementing law based administration.The outline provides standards of law based administration for local governments at all levels.Honesty principle,one of the most important regulations of law based administration,is the key to government authority.Correct understanding of honesty principle is a precondition for attainment of the goal of law based administration.The two 'administrative decisions' in the outline have different connotations as they are related to different subject when it comes to cancellation,withdrawal and alteration of administrative decisions.And the outline should conform to its higher level law,Administrative License Law of The People's Republic of China.
