BT投融资建设中有关法律问题的分析

Analysis of Legal Problems in Investing and Financing for BT Project

研究目的:近年来,BT模式在国内基础设施与公用事业项目中得到迅速引入和推广,但至今尚未颁布专门的法律对其进行规制,学界对其法律理论的特殊性亦认识不足,在实际运用过程中易引发法律方面的争议与问题,因此探讨BT投融资建设中有关法律问题对于我们建筑业企业来说具有重要意义。研究结论:为保障BT项目实施的品质和实际效果,政府部门在BT项目授予的过程中应采用更加灵活和宽泛的竞争方式,对于那些资质良好、综合实力强、业内口碑好的企业,可以通过多种方式尤其是邀请招标的方式来获得BT项目。国家应出台专门的BT模式的法律来规范该模式实施过程中出现的法律问题。

Research purposes：In recent years,the BT mode has been widely used for the infrastructure projects and the public utility projects,but up to now there is no special law on standardization and regulation of application of BT mode because its specificity of the legal theory is not well aware of,so the legal disputes and problems easily arise in the application.It is of the great significance for the construction enterprise to researching the legal problems in investing and financing for the BT project. Research conclusions：For guaranteeing the quality and actual effect of the BT project,the government departments should adopt more flexible and wider competition modes for granting BT project.The government departments should grant the BT project to the high-qualified,perfect overall strength and good reputation enterprises by adopting many ways,especially adopting the bidding way.The state should issue the special law on standardization and regulation of the legal problems in application the BT mode.
