现代产权理论视角下养老保险个人账户的产权问题

On Proprietary Rights over the Pension Account from the View Point of Proprietary Rights Theory

我国在养老保险个人账户产权方面存在的突出问题是:产权属性界定不明确,产权主客体责权关系不清,产权外部性问题突出等。当前,政府需要通过明确个人账户产权归属关系,建立个人账户私有产权法律保护体系,做实个人账户产权等手段来推动个人账户产权制度的可持续发展。

For a long time in the filed of the individual accounts’ property rights of Chinese pension system there exist the problems such as the vague definition of the property rights,the unclear rights and obligations among the property owners,and the externalities of ambiguous property rights.This Paper,based on the Modern Property Rights Theory,through analyzing the nature and specific features of the present individual account system,suggest that the constructive measures like clearly defining the individual accounts’ property rights,establishing property rights protection laws,and replenishing the present individual accounts should be taken immediately.
