On Category And Perspective Of The Case Research

案例研究区别于一般的案例分析,旨在透过案例总结与提升其中蕴含的部门法规则或法理问题。从研究所涉及的案例数量而言,有个案、类型化和整体性三种案例研究方法;从研究的视角而言,有部门法学、法理学和法社会学的三种案例研究方法。在我国法学发展和法治建设的时代背景下,案例研究应当成为法学研究的重要方法。

Legal research focuses on cases, which is absolutely different from general case’s analysis. Legal research summarizes the regulations in branch law and the legal philosophy existing behind the cases. From the perspective of the cases' quantity, there are three types of research methods:case by case, case category and cases in integrity. Form the perspective of researcher's angle of view, there are three types of branch law, jurisprudence and law of social science. In the context of China's legal development and legal construction, the case research should be considered as an important method in the whole legal research.
