论教育行政权力的边界——兼论中国教育行政权力边界守护机制 被引量:9

The Boundary of Educational Administrative Power——On Education Administrative Power Boundary

摘要 中国教育问题已成为公众关注的焦点,其核心指向教育行政权力过大。教育行政权力应有其边界,主要包括法制边界、专业边界和价值边界。法制不完善、教育行政体制缺陷及公众参与决策机制不完善等原因,造成中国教育行政权力容易逾越法制边界、专业边界和价值边界。为此,需完善教育法制,改革教育行政体制,增强教育行政的法制化、民主化和科学化。 A number of Chinese education problems are caused by the power of education administration. Clearing the boundary of educational administrative power is the key to promote education administration functions, to enhance the effectiveness of educational adminis- tration, and to promote the education development. In this paper, the boundary of education administration power is summed up as the boundary of law, profession and value. Imperfect law, deficient educational administrative system, and unsound public participation decision- making mechanism, caused educational administrative power beyond the boundary of law, profession and value. So it needs to improve the educational law, reform the educational administration, and strengthen the juridification, democracy and scientization of educational administration.
