基层公务员政策执行中的裁量问题探析

Study on Policy Discretion of Civil Servants at Basic Level during Policy Implementation

基层公务员是政策执行的主要承载者,是政策方案得以实现的主要行动者,基层公务员的政策执行关系到政策目标能否顺利实现及其实现的程度。在具体运用和执行政策过程中,我国基层公务员的政策裁量出现了滥用、违序、越权、怠慢乃至腐败等失范现象,严重地影响了党和国家的形象、声誉。基层公务员政策执行中裁量规范的防治对策:确立政策裁量基本原则以实现原则规制,完善信息公开制度充分释放民众参政热情,建立健全程序统制体系以实现程序正义,强化各类监督评价主体的作用,提升公务员的政策执行素养。

Civil servants at grassroots level are the main carrier and main actors of policy implementation.The policy implementation of these civil servants is related to the smooth realization of policy objectives and its implementation level.In the concrete application and implementation of policies,anomies such as abuse,order offence,ultra vires action,neglect and even corruption have occurred in these civil servant＇s policy discretion,seriously affecting the Chinese Communist Party＇s and the country＇s image and reputation.To this end,scientifically defining its concept and type,clearly understanding reasons for policy discretion anomies,setting corresponding norms and principles,and effectively developing prevention and control measures are of important practical significance and theoretical value.
