摘要
受传统观念的影响,大量夫妻共有房产仅登记在一方名下,另一方的共有权未能体现,成为隐名共有人。本文从分析隐名共有人作为真实权利人保护与登记公信力平衡入手,认为应当完善不动产登记制度,明确登记机构的审查职责,采取"夫妻联名登记",以实现对隐名共有人利益的保护。
Under the influence of traditional concept,many marital real estates have been only registered at one name.In order to make balance of the protection for real owners and the registration's public trust,we should take measures to strengthen the registration system,meanwhile,the couple's joint registration should also be taken.
