Disputes in International Law and the Diaoyu Islands Issue

法律争端作为《联合国宪章》上的国际争端,国家对此有和平解决的义务。在分权的国际社会中,由于司法解决争端并非常态,从司法程序的先决问题(管辖权和受理可能性)这一侧面讨论法律争端没有必要也无意义。实体问题中法律和事实的对立是争端形成的源泉;其客观存在的证据仍然需要和实体问题区分考虑。在钓鱼岛问题上,争端存在有着充分的证据。日方单方否认并采取所谓"国内法措施",违反和平解决争端之义务,须承担国家责任。

States are obliged to settle their legal disputes by peaceful means as the legal dispute is deemed an international dispute under the UN Charter.There is no compulsory judicial settlement of disputes in decentralized international society.Thus,it is unnecessary and meaningless to discuss the legal disputes from the perspective of preliminary questions（jurisdiction and admissibility） in judicial process.The conflict between law and fact in substantial questions is the source of disputes,and the objective evidence still needs to be distinguished from the substantial questions.The existence of the dispute on Diaoyu Islands has been proved by sufficient evidence.Japan＇s unilateral denial of the existence of the Diaoyu Islands dispute and its ＂domestic law measures＂ have already breached the obligation to settle international disputes by peaceful means and thus it should assume state responsibility.
