A Survey on the Legal Ethic of the Protection of Medicine Patent

药品专利法律制度因其伦理性价值取向获得了一定的正当性基础,它体现了法律制度在现实条件下的实然性选择。对药品专利权与社会需求矛盾所引发药品专利保护合理定位的思考,应当放在法的应然与实然的不同层面,并通过最终的伦理应然性考量得以修正和完善。

Owing to the ethic value orientation,the legal system of medicine patent has acquired its reasonability and legitimacy,which reflects the legal system＇s real choice under the condition of reality.Caused by the contradiction between medicine patent and social demands,the meditations on how to reasonably locate the protection of medicine patent should be put into the ideological and realistic levels of law,and finally be revised and improved through the consideration of ethic ideology.
