国际体育仲裁中指定仲裁员的独立性与公正性——以Alejandro Valverde兴奋剂案为视角

On the Independence and Impartiality of Party-Appointed Arbitrators in International Sports Arbitration:On the Case of Alejandro Valverde

仲裁员的独立性和公正性是仲裁制度得以生存和发展的重要保证。在三人仲裁庭中,各方当事人各自指定的仲裁员应当与首席仲裁员承担同样的独立性和公正性义务。国际体育仲裁,相比一般仲裁具有较强的专业性和特殊性,权威体育仲裁机构所提供的符合要求的仲裁员人选大多与某些体育组织有客观联系,而这些体育组织又往往会成为体育仲裁中的一方当事人,因此这些仲裁员的独立性和公正性常常会遭到质疑,但并不能因此就对体育仲裁中的指定仲裁员苛以更加严格的独立性和公正性标准。

The independence and impartiality of arbitrators is the important basis of the arbitration system.Party-appointed arbitrators should fulfill the same standard of impartiality and independence as the chairperson of the arbitral tribunal.In contrast to the general arbitration,the international sports arbitration has its specificities and particularity,namely the limited choice of arbitrators engendered by the Court of Arbitration for Sport closed list system and the requirements imposed to listed arbitrators.These peculiarities imply that arbitrators for international sports arbitration may be led to have contacts with sports organizations,which maybe one party of the sports arbitration.However,this is not sufficient ground to question their independence and impartiality and thus to apply a more stringent standard.
