摘要
我国当下公用事业特许经营立法存在法律位阶过低、形式合法性缺失、不同文本相互冲突等突出问题,致使公用事业市场化改革隐藏着巨大风险。通过梳理现行公用事业特许经营立法文本,可以发现其在特许设定、适用范围、市场准入、价格监管、争端解决等诸多环节中存在疏漏。为此,应当通过中央、地方立法权限的划分、统一立法体例的完善以及不同立法之间的互动,为消解公用事业特许经营法律困境奠定基础。
The legislation of utility franchise in China has some outstanding problems,such as low-level legal hierarchy,lack of formal legality,mutual conflict among different texts and so on,which result in enormous hidden risks in utilitiy market-oriented reform.We can find some defects in franchise enactment,scope of application,market access,price regulation and dispute settlement through combing legislative texts of existent public utility franchise.As a result,we should lay the foundation for resoluting the legal difficulties through legislative competence division between central and local governments,uniform legislative style completion,and interaction among different legislations.
