中国法律方法论研究是否应拒绝诗性思维

Should Thought in Poetic Form be Rejected in Chinese Legal Methodology Studies

在中国法律方法论的研究中,诗性思维似乎要成为一个亟待摆脱的羁绊。诗性思维作为一种思维方式,因其对逻辑思维规则的拒斥而与逻辑思维相对立。但是,它乃是中国传统文化的固有特征,已沉淀为中国人的思维方式,是中国人思考问题、解决问题过程中的一个无法回避、无法剔除的因素。仅仅把诗性思维方式看作中国法律方法论研究的羁绊无助于中国法律方法论的建构。

Thought in poetic form seems to be trammels needed to shake off in Chinese legal methodology.Thought in poetic form,as a particular form of thinking,counterpose with logical thinking for it reject the rule of the latter.Thought in poetic form is inherent characterization of Chinese traditional culture,and become a thinking form of Chinese people.It is an important factor that can not be neglected by the Chinese people when they thinking and solving the problems.If the thought in poetic form was regarded as trammels,it isn＇t helpful to build the Chinese legal methodology.
