浅谈对构建我国农地信托之基础——信托财产的认识

Trust Property:On the Base of Rural Land Trust in China

目前,国内对农地承包经营权信托制度的研究略显不足,尤其对信托财产——农地承包经营权研究甚少。文章认为,农地承包经营权具有合法性、流通性,能成为信托财产;农地承包经营权作为信托财产的权利应该归属委托人而不是受托人;农地承包经营权作为信托财产之独立性是指与委托人其他的与信托事务无关的财产相独立。

Researches on the trust mechanism of contractual operation right of rural land is not enough,especially on trust property.Due to the contractual operation right of rural land is legal and movable property,it can be turn to trust property;trust property,contractual operation right of rural land should belong to the principal and not trustee;the independence of trust property means that it should be separated from the other principal＇s property
