经济危机中的贸易保护主义与中国的应对策略——以“两反一保”措施和经济刺激计划为对象

Trade Protectionism in the Economic Crisis and China's Strategy

自2008年美国开始的世界经济危机后,各国违反WTO规则的贸易保护主义现象抬头,突出表现在包括许多国家对"两反一保"措施的滥用和经济刺激计划中的歧视性条款。在他国的"两反一保"措施方面,中国应重视研究部分发展中国家"两反一保"措施的滥用问题和某些国家在"两反一保"措施上的新动向,及时将它们滥用"两反一保"措施的行为诉诸WTO争端解决机构。同时,对他国经济刺激方案中的贸易保护主义内容,中国也应利用自身的"两反一保"措施和WTO相关规则加以有力制约。

In this economic crisis,the obvious phenomenon of trade protectionism of violation of WTO rules includes the abuse of anti-dumping,countervailing and safeguard measures and discriminatory clauses in the economic bailout plans.For the anti-dumping,countervailing and safeguard measures,China should pay attention to the abuse of anti-dumping,countervailing and safeguard measures by the developing countries and new development of some countries and sue them through DSB in time.Meanwhile,for the discriminatory clauses in the economic bailout plans of other countries,China should use its own anti-dumping,countervailing and safeguard measures and WTO rules to counter them.
