预防接种纠纷主要有疫苗质量纠纷、不当接种纠纷和不良反应纠纷三种类型。不同种类的疫苗的接种会形成性质不同的法律关系。接种第一类疫苗形成的主要是行政法律关系同时兼有民事法律关系的成分,接种第二类疫苗所形成的则是纯粹的民事法律关系,损害赔偿责任的性质为民事赔偿。

There are mainly three types of disputes caused by vaccination： vaccine quality disputes, wrongful vaccinating disputes and adverse reaction disputes. The nature of legal relationships in vaccination differs according to the type of vaccines. The first kind of vaccine inoculation is administrative legal relation in nature, but it also has some characters of civil relations at the same time. The second kind of vaccine inoculation is civil relation purely, and the nature of liability is civil compensation.
