西安市城市地上地下土地权利调查研究

Research on Ground and Underground Urban Land Rights of Xi' an City

目前,我国正处于城市地上地下空间建设的快速发展阶段,然而由于立法滞后,地上地下空间开发利用中土地权属管理面临越来越多的新问题。根据原有的土地管理法律法规、政策文件来管理城市地上地下土地权利,已不能满足现阶段经济社会发展对城市土地利用和管理提出的新要求。通过对西安市城市地上地下土地权属的调查和对城市地上地下土地权属管理相关问题的思考,全面分析了西安市城市地上地下土地权属管理现状特点及土地权属管理中普遍存在的问题,最后提出了一些对策建议,供有关部门决策参考。

China is at the stage of rapid urban ground and underground construction; however, due to the lagged legislation, more and more new problems are emerging in the development and utilization of ground and underground space. It can no longer satisfy the new requirements of social and economic development for the management of urban ground and underground space land rights using the current land administration law and policy documents. Based on the implementation of national resource projects and the considerations of the management of urban ground and underground land rights, this paper analyzes the characteristics of and the problems in urban ground and underground land rights management, and puts forward some countermeasures and suggestions for the governmental departments concerned
