On the Discretion in the Executive Enforcement of Law of Firefighting

阐述自由裁量权的历史嬗变,分析消防行政执法中的自由裁量权存在的原因与形式,并深入剖析自由裁量权不当行使的原因,在此基础上,提出了保障正确行使自由裁量权的措施和建议,以期促进社会公平,保障法治正义。

Focusing on the discretion in the executive enforcement of law of firefighting,this paper expatiates upon the historical evolution of discretion,analyzes the causes and forms,and probes into the causes for inappropriate exercise of discretion,and thus puts forward the measures and suggestions to guarantee the correct exercise of discretion in hoping to promote social equality and ensure legal justice.
