摘要
工程项目代建制中代建方的定位表现在以下几方面:代表业主对工程项目的组织实施进行全过程或若干阶段管理和服务;代建合同范围内,代建人作为拥有专业化知识和经验的行为主体,必然起主导作用;代建人作为工程项目委托代理链中的管理层代理人,一方面要对工程项目进行组织实施管理,约束承包商的行为;另一方面要规范自己的行为,积极接受委托人的监督和考核(评价);代建合同的标的是向业主提交满足合同要求的管理服务,最多是项目全过程的咨询管理类服务;代建方一般既不可能承担成本失控的全部风险,也不会享受工程成本降低的所有效益。
On behalf of the owners,the construction agents will manage the entire process or certain stages of project and provide services for the organization and implementation of projects.Within the agent contract,they,with specialized knowledge and experience,will act as the leading role.The construction agents who act as the management agents in the principal-agent chain projects,should organize the implementation of the project management and bind the contractor's behavior on the one hand,and on the other hand,regulate their own behavior,and actively accept the client's monitoring and evaluation(evaluation).The agent contract goal is to be submitted to the owners of the management services to meet the contract requirements and the whole process of project management consulting services to the majority class.On behalf of the party,the agents will not bear the cost of all the risks in the construction when it is out of control normally,neither will they enjoy the benefits of cost reduction in the projects.
