On Baogu System in the Tang Dynasty Based on the Case of Qu Yuan-heng's Crime of Klling Bo Gongcheng's Mother

保辜制度是中国古代刑法为处理伤害案件创立的一种特殊的法律制度。古代保辜制度从产生到成熟经历了一个漫长的历史演进过程。唐律作为中国古代法典范,对保辜制度作了最为详细而全面的规定。儒家思想渗透于唐律,对唐律及唐代司法实践产生了重要影响。现结合曲元衡杖杀柏公成之母案来探析唐代保辜制度以及儒家思想对唐代司法实践的影响。

The baogu rule is a kind of special legal system to deal with injury cases in ancient China.It experienced a long process from its birth to its maturity.As a model in ancient laws,the law in the Tang Dynasty was the most detailed and comprehensive in expanding the baogu rule.The law in the Tang Dynasty was fully influenced by Confucius ideology,and the latter impacted the former significantly.The present paper focuses on a discussion on the baogu rule in the Tang Dynasty based on the case of Qu Yuan-heng＇s crime of klling Bo Gongcheng＇s mother and the great impact of Confucian ideology on the judicial practice in the Tang Dynasty.
