An Introduction to the Thoughts of Criminal Law in China's Warring States Period and Europe's Era of Enlightenment——From the Perspective of the Cultural and Historical Roots of East and West

从时代精神的演进及其与社会实践的互动的角度切入,梳理战国时代与启蒙时期的历史发展线索,把握中西刑法精神的演进及其历史生成条件,发掘战国与启蒙时代刑法思想的异同,探寻战国与启蒙时代刑法思想异同及其历史、文化根源,以求对中外刑法思想、刑法传统与刑法现代化问题的深刻体认。

From the perspective of the evolution of the spirit of times and its interaction with social practice,this paper attempts to find out the evolution of Chinese and Western criminal law spirit and its historical condition so as to have a profound understanding of Chinese and western criminal law thoughts,criminal tradition and the modernization of criminal law by revealing the difference and similarity between the thoughts of criminal law in China＇s Warring States Period and Europe＇s Era of Enlightenment,and exploring into the cultural and historical roots of east and west.
