在社会性规制进程中,规制者与被规制者冲突的解决方式选择直接影响到政府规制的效率和社会公平。从社会性规制的特殊性出发,通过建立规制者与被规制者之间冲突的司法判决模型,研究司法判决的公正性对规制双方行为的影响。结果表明,司法判决的结果对社会性规制的效率以及社会秩序的公正与和谐有着重要提升和指引。

In the process of social regulation,the choice of solutions to the conflict between the controller and the controlled will directly affect the efficiency and social equity of government regulation.The paper starts from the particularity of social regulation and establishes a judicial decision model of conflict between the controller and the controlled to study the influence of judicial decision impartiality on control.It concludes that the result of judicial decision plays an important role of promotion and guidance for the efficiency of social control and the equity and harmony of social order.
