摘要
自《中华人民共和国消费者权益保护法》颁布实施后,人们普通希望能依此法处理医疗纠纷。但医患之间并非市场交易关系,医院也不是经营者,而消费者权益对患者也不甚适宜,因此医疗纠纷不能依消费者权益保护法解决,应当另辟蹊径。
Since the Law of Consumer Rights and Interests Protection brought into effect,it is a hope of solving medical dissension by the Law of Consumer Rights and Interests Protection.Because the relationship of doctor and patient is not like that of market exchanging and the hospital is not a proprietor,so the Law is not suit the patient,and solving medical dissension should not base on the Law of Consumer Rights and Interests Protection.We should adapt the law to protect the rights and interests of doctor and patient.
