Brief Analysis of Three Features of Roman Law

古代罗马社会传给我们有形的精神文化遗产中,最著名的一项就是罗马法。罗马法既是古代社会最发达的法律体系,也构成了近现代西方法和法学的历史基础。为了更清晰的认识罗马法,本文从不同的视角,简述了罗马法的三个特征:法与法律的对立与统一、宗教与皇权的结合、保守性与灵活性的统一。

Roman law is the most famous tangible spiritual and cultural heritage that the ancient Roman society hands down to us.The ancient Roman law is not only the most developed social legal system,but also the historical basis of the modern western law and law.In order to get more clear understanding of Roman law,this paper introduces its three features briefly from different aspects of the opposite and uniformity of law and the law,the combination of religion and imperial power,and the unity of conservatism and flexibility.
