摘要
危险废物的非法转移是近年来出现的规避环境监管的新型违法形式,其性质恶劣、危害极大、隐蔽性强。在此以一起危险废物跨省非法转移案件为例,剖析了案件发生的根源,明确了现行法律与实际不适应、环境监管缺失、舆论宣传力度不够、危险废物处置现状堪忧、缺乏危险废物信息共享及信息通报制度、危险废物应急反应能力低下是制约城市危废监管能力提高的主要因素,提出了加强危险废物监管的对策和建议。
Illegal displacement of hazardous waste became a new illegal form of evading environmental supervision during recent years. It brought a bad influence, huge harm and high concealment. An example was given for illegal displacement of hazardous waste across two neighboring provinces. Some important reasons were discussed about the illegal displacement case, such as inapplicability between current laws and actual work, lack in supervision of environmental protection, absence of propaganda in public, poor actuality in the treatment of hazardous waste, scarcity of informational share system and inibrmational communication institution in hazardous waste management, and low ability of crisis treatment of hazardous waste. Some new solutions were also brought forward about supervision of hazardous waster.
