论工会对农民工劳资关系之协调

On Labor Union's Coordination of Labor Relations of Migrant Workers

在构建社会主义和谐社会进程中,农民工的合法权益备受关注。农民工维权的道路异常艰辛,劳资冲突的形式复杂多样,双方博弈的结果令人堪忧。在寻求解决冲突的路径方面,工会组织纳入研究者的视野。在工会作为农民工维权载体的可行性论证中,工会的内涵揭示其保护工人权益的本质,彰显其壮大工人维权的力量。深入剖析现代西方工会职能,在批判中借鉴,在发展中重构我国工会运行机制,相信我国工会组织在制度创新中一定会成为包括农民工在内的广大劳动者维护自身合法权益、缓解劳资关系紧张的不可替代的角色。

During the building of a socialist harmonious society, migrant workers＇ legal fight has been paid attention. The rights protection is rather difficult and the conflict of labor relations seems extremely different, so the result of gaming is not optimistic. When researchers pursue the solutions to conflict, labor unions go into their perspectives. In the feasibility study of migrant workers being the subject of rights protection, the connotation of labor union reveals its mission of protecting workers＇ rights and enhancing the power in protection. We should study the function of Western labor union and draw their experience critically, rebuilding the mechanism of our labor union. The author believes that in system innovation, our labor unions are bound to play a key role when protecting the legal rights of workers including migrant workers and releasing their labor relations.
