监外执行状态下女性罪犯生育权的限制

Restrictions on reproductive rights to female offenders under probation

本文基于女性罪犯在监外执行中利用生育机会规避刑罚执行的具体实例,提出现行暂予监外执行制度妨碍了刑罚的司法公正与效率,应通过调整监外执行的效力为中止执行,堵塞制度漏洞;针对当前保护女犯生育权的主流学术观点,笔者认为应从维护刑罚目的出发,对女犯生育权给予必要的限制,制度措施包括:考察婚姻关系的合法性、提高女性罪犯的生育门槛等。

Based on the specific instances of female offenders＇ using reproductive opportunity to avoid execution of punishment in the probation, put forward that the current system of temporary probation prevents judicial fairness and eflaciency, which should be adjusted from the effectiveness of probation to the suspension of execution to plug the loopholes in the system; Aiming at the current mainstream academic point of view on protecting female reproductive rights, the author believe that we should start from the purpose of maintaining the punishment to give the necessary restrictions on female reproductive rights. The system include： study the legality of marriage, increase the reproductive thresholds for female offenders, etc.
