刑事申诉制度是刑事诉讼中的重要制度,刑事诉讼法对其作出了明确规定。尽管如此,我国刑事申诉制度仍有许多不尽如人意之处,在理论界引起了极大的争议,在实践中存在诸多问题。如何对其进行完善,是当前司法改革中必须关注的一个现实问题。

Criminal appeal system is an important institution of criminal proceedings.The criminal procedure law has made it clear.Nevertheless,there are still many defects in criminal appeal system,which cause great controversy in theoretical circles and many problems in practice.How to perfect it becomes a necessary issue that must be concerned about in current judicial reform.
