我国社区矫正的理念调整与制度设计

On the Adjustment of Idea and Design of Systems for Community-based Corrections

社区矫正是一种与监禁执行相对应的刑罚执行方式,是行刑社会化趋势的一个体现。社区矫正的理论基础,主要有刑罚人道主义、教育刑理论、刑法谦抑性思想、刑罚经济性原则和复归理论等。我国从2003年开始社区矫正的试点工作,迄今已近8年。2011年2月,社区矫正的表述已经载入刑法典第八修正案。针对我国社区矫正试点工作中的经验和问题,需要从根本上反思我国的刑罚执行理念,在此基础上着手起草统一的"社区矫正法"。

Community-based Corrections is a method of penalty implementation, which is opposite to imprisonment. Its theory basis includes humanitarian, educational penalty, the principal of compress and modesty, economical principles in criminal penalty and reverting theory. From 2003, China picked several provinces as the pilot to try Community-based Corrections. Nowadays, it＇s the time to analyses the problems and experience in pilot. We need to think the adjustment of idea and the design of the systems about Community-based Corrections too.
