知识产权制度的中国传统法哲学思考

Intellectual Property Regime:A Perspective of Traditional Chinese Law Philosophy

中国知识产权制度起步较晚,时至今日,先后颁布了专利法、著作权法等法律法规,以求与国际知识产权规定相一致。由于西方文化侵袭等因素的影响,我国的知识产权制度烙上了"外来强制,形式输入"的印记,与我国国情还不太相符,仍需完善。从中国传统法哲学的角度入手,以"中庸"为视角,通过对知识产权制度本土化建设的探讨,来考量知识产权制度的中国化道路。

Intellectual property regime in China started late,and so far,China has promulgated a series of laws,including the Patent Law and Copyright Law,in order to be consistent with international intellectual property provisions.Having been influenced by Western cultures,the Chinese intellectual property regime was characterized by ＂foreign influence and formal input＂,which is inconsistent with the condition of China and needs to be perfected.This paper discussed the naturalization of intellectual property regime from the perspective of traditional Chinese law philosophy,especially from the Confucian philosophy of ＂Golden Mean＂.
