摘要
通信自由是公民的一项基本权利,我国宪法和其他法律对其都有所规定,但由于我国宪法及其他法律、法规的规定存在的不足,公民通信自由和通信秘密并没得到很好保护。为了对公民通信权利进行更好的保护,首先分析现状及不足,并着重分析与公民通信权利保护的构成冲突的两个问题,最后提出了完善我国通信自由与通信秘密法律保护的建议。
The freedom of correspondence is one of the basic civil rights. However, because of the insufficiency in our Constitution and other laws and regulations, citizens＂ freedom and privacy of correspondences haven＇t been well protected. Firstly, this article analyzes related clauses in current laws and discusses their insufficiency. Then, it emphasizes two cases that conflict with the constitution of protecting citizens＇ rights of correspondence. Lastly, it proposes the ways of improving the citizens＇ freedom and privacy of correspondence in China.
