权利与义务:西周的婚姻制度及现实启迪

Rights and Obligations-the Marriage Institution and Realistic Enlightenment of Western Zhou Dynasty

西周王朝建立初期,摈弃了许多原始婚俗,制定了婚姻三原则,并详细规定婚礼要经过"六礼"的程序。不仅注重个人婚姻自由的实现,也强调婚姻的社会属性和社会功用,对后世产生了深远的影响。面对我国目前出现的婚恋和婚姻问题,要认识到婚姻并不只是关乎公民个人权利自由,应该提倡婚姻权利与义务的对等,消除权利实现上时间和空间的差序格局。

In the early Western Zhou Dynasty,three principles and ＂six-li＂ was established.This kind of marriage system not only laid stress on the freedom of personal marriage,but also on the social attribute and social public of marriage,which having long influence on later generations.As far as Chinese present marriage and matrimony problems were concerned,we should have a clear understanding of that marriage is not the matter of personal individual freedom issue,but also advocate the equity of marriage rights and duties,and eliminate rights in deed,then bringing about diversity-orderly structure lying in space and time.
