摘要 伴随我国经济的快速发展,房地产业的发展速度也日益高涨,与之相伴的是高涨的房价。开发商和一般的卖房者为了获取更高的房屋出售价格,"一房二卖"乃至"一房多卖"的情形已屡见不鲜,纠纷不断,严重侵犯了正常购房者的合法权益,扰乱房地产市场秩序。根据我国物权变动模式及登记要件主义,来探讨"一房二卖"的法律效力,以及房屋所有权的最终归属。并对未能取得房屋所有权的买受人如何维护自己的的合法权益,提出建议。 With the rapid development of economy in our country,real estate industry develops repidly,and also prices of house rise at the same time.To get more benefits,"a room sells twice" and "a room sells more than once" case has been common situation together with disputes,that is a serious violation of the lawful rights and interests of the normal homebuyers and it disturbed the order of real estate market.According to China's property rights changes mode and registration requirement to discuss "a socialist,for buildings two legal effectiveness,and the ultimate Ownership belongs,this paper puts forward some suggestions to the buyers who fail to win the ownership of the house and ell them how to safeguard their lawful rights.
