摘要
科技法律因其专业性强,运用了较多的技术性规范,而忽视了其价值性规范,导致多数科技法律无法真正实施。只有在科技立法的法律目的、法律原则和法律规范的体系和逻辑结构中,将技术规范和价值规范很好地结合起来,才能实现科技立法的指导、评价、预测与制裁功能。
Because there are much more technical specifications than value specifications in science and technology legislation which is highly professional, so lots of science and technology law cannot be easily enforceable. The guiding, evaluating, forecasting and sanctioning function of science and technology legislation can be realized only by well combination of technical specifications and value specifications in the legal purpose, principal, regulation system and logical structure of science and technology legislation.
