2008年以来人民法院司法政策实证研究——以最高人民法院司法解释为主要对象的分析

An Empirical Study of Judicial Policies Issued by the People's Court Since 2008——Based on the Judicial Interpretations Issued by China's Supreme People's Court

司法是贯彻落实中国共产党和国家方针政策、维护社会稳定和促进经济社会发展的重要力量和手段。很多情况下党和国家的政策是通过最高人民法院发布司法解释等司法文件的形式将其转化为司法政策,进而在司法实践中得到贯彻和落实的。2008年以来最高人民法院面对国内外形势的发展变化,通过发布司法解释等形式不断出台和调整司法政策,积极回应党和国家的重要方针政策,为促进经济社会又好又快发展和构建社会主义和谐社会作出了重要贡献。

The administration of justice is a crucial means and guarantee of implementing various principles and policies of the Communist Party of China,maintaining social stability and promoting sound economic and social development.In many cases,the policies of the party and the state are transferred into documented judicial policies of the country by means of judicial interpretation issued by the Supreme People＇s Court,and these policies then become materialized in real judicial practices.Since 2008,in light of changing international and domestic situations,there have been a number of enactments or adjustments of China＇s judicial policies in the form of judicial interpretation by the Supreme People＇s Court.These policies have been positively responsive to the guidelines,principles and policies of the party and the state,and have made important contributions to the sound and fast economic and social development of China as well as to the initiative of building a socialist harmonious society with Chinese characteristics.
