论组织、领导、参加恐怖活动组织罪刑罚配置的完善

On Consummation of Penalty Equipment in Crime of Organization,Leadership,Participation in Terrorist Organizations

对照外国的反恐刑事立法经验,我国刑法第120条关于组织、领导、参加恐怖活动组织罪的规定在刑罚配备方面需进一步改进:一是微调该罪的"分类配刑模式",更好地体现"罪刑相适应"原则;二是在从减轻与从加重情节方面增加刑罚配备的多维性,使我国的刑法规定得到进一步完善。

Contrast to the foreign anti-terrorism legislation experience,the provisions of article 120 in Criminal Law of the People＇s Republic of China need to be further improved.One is changing the classified pattern of criminal penalties slightly,in order to reflect the principle of suiting punishment to crime better.Another is increasing the dimensionality of punishment from mitigating circumstances and aggravating circumstances,in order to be further improved criminal law.
