摘要
自从物流概念产生后,传统的交通运输被重新审视和定位,用物流的理念进行交通运输系统的资源整合,交通运输逐步向物流转型,与物流融合,协调发展。而物流法律制度却缺乏物流系统论的理念,现行的所谓物流法只是零散的物流各环节的部门法,只能给物流法提供一个个法律碎片。构建国际物流法律体系应当用系统论的方法,确保物流各环节的法律以物流系统的融贯为指导,建立以运输法为物流法律系统的核心,以海商法为龙头的整全的国际物流法模式。统一国际运输法律公约实现了向国际物流法的嬗变,对构建国际物流法模式做出了实证性的探索。
The transportation has been re-examined and positioned since the logistics terminology was generated. The concepts of logistics have gradually integrated transportation and logistics,with transportation evolving towards logistics in a coordinated and integrated manner. However, a lack of system theory of the logistics exists in the field of the legal system of logistics. The current so-called logistic laws are scattered in logistics departments,only providing legal fragments. Constructing the legal system of international logistic systems should be based on the system theory, ensuring laws of logistics as a fundamental principle,making transportation laws the core of logistic laws and maritime laws as the leading international logistic law mode. Unity Convention on the Law has achieved the transfer of international transport logistics to the international logistic law,and has made an empirical exploration in building international logistics law mode.
