Review on The High-end Forum of Complicated Legal Problems on Liquidation and Exit Mechanism in Banking Industry"

为配合有关部门制定银行业金融机构破产条例的需要,召开了"银行业清偿退出机制疑难法律问题高端论坛",以期通过与会专家、学者们的讨论,解决条例制定过程中面临的一些尚待解决的法律问题。为此,与会者针对条例制定中面临的立法技术、具体规则,以及行政监管等方面的问题提出了各自的意见与建议。笔者对一些观点进行评论,并提出一些不同见解。

A High-end Forum. ＂Complicated Legal Problems on the Liquidation and Exit Mechanism in Banking Industry＂ is held to meet the needs of experts and scholars in relevant government departments in a bid to solve some legal problems, faced during their attempt to draft the regulations on bankruptcy of banking and financial institutions. The participants, bringing up comments and suggestions of their own, discuss the problems in drafting the regulation, including those related to legislation skills, specific rules, administrative supervisions, etc.
