摘要
欺诈性抚养的实质涉及受欺诈方权利受到侵害及其法律保护问题,受害人若一并提出损害赔偿请求,法官应给予支持。损害赔偿不仅包括财产权,还应包括人身权,即人格权中的知情权、亲情权、生育权和身份权中的亲权。
The essence of frandulent child support relays to the rights damage and legal protection of parties which was cheated.Once the victim require the damage compansition,the court should support this requirment.The damage compansition include not only property rights but also personal rights,especially the rights of know,identity,birth and parental.
