港口经营人抵押权之刍议

On mortgage right of the port operator

针对港口经营中出现的港口流动存货抵押的实践情况,采用实例、比较、归纳等方法,结合《中华人民共和国物权法》关于浮动抵押的法律规定,探讨和研究港口经营人的抵押权,并对如何完善港口经营人该项权利提出建议,主张对《中华人民共和国物权法》的浮动抵押规定进行细化,以更好地保护该项权利,同时在《中华人民共和国港口法》等法律规范中增加包括抵押权在内的港口经营人权利方面的内容,以适应实践的发展。

Aiming at the practice of the floating inventory mortgage in port operations,using examples and by way of comparison as well as induction,combined with the relevant provisions of the Real Right Law of P.R.China on floating mortgage,discussion is made on the port operator＇s mortgage right with some suggestions for its perfection such as elaborating the provisions on floating mortgage and introducing relevant provisions in the Port Law of P.R.China on the Mortgage right of the port operator.
