摘要
在国际商事仲裁中,仲裁庭和法院对争议事项可仲裁性问题进行审查时,通常适用仲裁地法或法院地法.其实,各国关于争议事项可仲裁性的立法意在划分本国法院和仲裁庭之间对特定争议的管辖权,立法规定不可仲裁的事项是各国立法为本国法院保留的一块自留地.只有当法院对争议的专属管辖权受到威胁时,才有适用仲裁地法或法院地法的必要.从支持仲裁的角度出发,仲裁庭和法院应适用使争议事项具有可仲裁性的法律.
In international commercial arbitration, arbitral tribunals and courts often apply lex arbitri and lex fori when they review the arbitrability of dispute items. In fact, legislation about arbitrability of dispute items in each country aims to divide jurisdiction over particular dispute between national courts and arbitral tribunals, and non-arbitrable items provided by legislation are a private plot for national courts, which is retained by legislation of each country. There is no necessity to apply lex arbitri or lex fori unless the courts' exclusive jurisdiction over disputes is threatened. From the perspective of pro-arbitration, arbitral tribunals and courts should apply the law which makes dispute items arbitrable.
