Tentative Probe into the Problems of Private Law Culture Construction in Rural Community

随着法治改革不断深化,通过私法立法缓慢的带动农村私法文化的建设,已经不适合新农村城镇化的迫切需要。一方面,农村私法文化的建设既困难重重又面临着种种契机;另一方面,由于我国农村社区和农民的特殊性、私法制度与私法文化建设的非同步性,我国农村私法文化的建构必须走以城镇化为突破点,把国家推进与民间演进有机结合,由大城市辐射小城镇再由小城镇过渡到其他一般农村区域的路径。

With the development of legal reform,to slowly promote the construction of rural China private law culture by legislation of private law is no longer applicable to the urgent demands of the new rural urbanization.On the one hand,private law culture construction in rural community is faced with many difficulties and opportunities;on the other hand,due to the particularity of rural community and farmers,and the construction synchronicity between private law and private law culture,the construction of rural China private law culture must take the urbanization as a breakthrough point and follow a path from big cities to towns and then to villages.
