Balance Between Interest and Copyright Protection in Cyberspace

本文以版权保护范围、保护标准、保护水平为视角,阐述了网络环境下版权人权益空前强化导致利益失衡的表现,从开放性创新理论、Copyleft理念、公有领域切入梳理了网络环境下版权保护利益平衡的理论根基,从版权人与传播者及使用者、版权人与教育机构及数字图书馆、版权人与版权集体管理组织的立场出发,探讨了网络环境下版权保护利益平衡的制度构建。

From perspectives of the scope of copyright protection,protection threshold and protection levels,this article points out the imbalance of interest for the unprecedented reinforcement of protection of the copyright owner’s rights and interests in the cyberspace.The article makes an analysis of the theoretical basis of balance between interest and copyright protection in the cyberspace in terms of open innovation theory,copyleft concept and public domain,and discusses how to design a system of balance between interest and cyberspace copyright protection in the shoes of disseminators and end-users,educational institutions and digital libraries,and copyright collective management organizations as against copyright owners.
