摘要
大学作为管理者与被管理者组成的法权组织,是一个由多元法权主体组成的共同体。大学治理的实质就是大学各个利益相关群体之间的法权配置,主体间的法权配置模式即为大学的治理结构。大学治理结构的型塑应从大学法权配置入手,重建大学法权结构,将"互侵式"法权结构转变"互动式"法权结构。具体路径包括重构大学的外部法权结构、优化大学的内部法权结构。
University,as a legal-right organization of managers and members,is a community composed of multivariate legal-right subjects.The essence of ＂university governance＂ is how to allocate the legal right between each body in university management,and the mode of legal right allocation between them is governance structure of university.Shaping governance structure of the university should begin from legal-right allocation to reconstruct the legal-right structure of the university,to change from ＂mutual infringed＂ legal-right structure into ＂interactive＂ legal-right structure.The route is that the government should decentralize power to further expand university autonomy for reconstructing external legal right structure of university;form the constrained mechanism of power for optimizing internal legal-right structure of university through the balance of power,power autonomy and moving down the power gravity.
