Research on the Administrative Protection of Intellectual Property

在我国知识产权保护体系中,知识产权的行政保护有着司法保护不可替代的作用,其优势在于政府可以运用多种行政手段保护知识产权,加强保护力度,提高保护效率。从知识产权行政保护的基本概念、法律特征等理论问题看,知识产权行政保护应该是政府为保护知识产权所进行的行政管理或行政执法等具体行政行为和抽象行政行为的总和。从我国现行的知识产权行政保护制度及其执行现状看,存在制度缺陷和执行失范等问题。为了有效解决知识产权行政保护制度缺陷和执行失范,有必要完善法律制度,融合执法资源,改善执法环境,开展综合执法,改变执法方式。

Administrative protection plays a replaceable role comparing to judicial protection with regard to protection of intellectual property in China,since the government can protect intellectual property by various administrative means,therefore administrative protection could increase the force and the efficiency of the protection.In terms of the basic concept and legal characteristics of administrative protection,it covers all administrative activities,both concrete and Abstract,that government conducted in order to protect intellectual property.Regarding the current situation of administrative protection of IP in China,the problems concerning enforcement of law,as well as the shortcomings of law,are still serious.Therefore,it is necessary to perfect legal system,integrate executive resources,improve environment of law enforcement,promote comprehensive measures,change traditional ways into modern ones in order to achieve the aim of rule of law in China.
