摘要
目前我国的保险消费纠纷替代性解决机制看似多元,实则并没有为保险消费者提供一个多元、畅通和低成本的救济渠道,因此亟待从维护保险消费者权益和便利消费者维权的角度出发,构建一公平、合理与便捷的保险消费纠纷替代性解决机制。从根本上讲,要本着保护消费者的目的,对我国保险消费纠纷替代性解决机制做出体系化、专业化和结构化的思考,从而确保消费者在替代性纠纷解决机制中享有充分的自主选择权,并且体现出非诉讼解决机制在便利性与低成本方面的优势。
There seems to be multiple solution mechanisms for insurance disputes in China, but there is actually no diversified, smoothly-running and low-cost relief channel for insurance consumers. Therefore, it is important for us to establish a fair, reasonable and convenient alternative insurance disputes solution mechanism for the objective of safeguarding the interests of insurance consumers and facilitate their claims to their due rights. We should, from the perspective of protecting consumers, carefully scrutinize the current alternative solution mechanisms to insurance consumption disputes systematically, professionally and structurally, so that consumers will enjoy sufficient independent right of choice in seeking alternative solutions,and at the same time ,demonstrate the mechanism's advantages of convenience of use and lower cost as a non-lawsuit solution mechanism.
