论采风权与肖像权的冲突与协调

我国传统的法学理论普遍认为,在权利与权利之间是可以明确划出一条清晰的界限的,只要一个人能够正确合理地行使自己的权利,一般认为是不会侵犯他人的权利的,但是从法律经济学的分析可以看出由于权利具有相互性,所以权利与权利之间会产生冲突,肖像权与采风权之间也不例外。为解决肖像权与采风权之间的冲突,要对肖像权进行合理限制,基于以下五个方面可以不经权利人许可使用他人的肖像——依法强制使用肖像或为了肖像权人本人的利益使用其肖像;出于新闻报道的目的而使用新闻价值人物的肖像;行使舆论监督权而使用他人肖像;基于科学研究或文化教育目的而在特殊场合使用他人肖像;其他以社会公共利益为目的而确有必要使用自然人的肖像。

China＇s traditional legal theory generally agreed that there is a clear boundary between rights.As long as one can properly and reasonably exercise their rights,generally speaking,they can＇t infringe the rights of others.But rights are mutual from the analysis of law and economics,therefore,there are conflicts between rights,Portrait right and portrait are no exception,In order to solve the conflicts,we have to put reasonable restrictions on portrait right.Based on the following five aspects,others＇ portrait can be used without the permission of obligee.
