摘要
农村土地承包经营权作为一种新型用益物权在《物权法》中得到确认,并具有可流转的特性。农村土地承包经营权流转的价值可定位为:发展适度规模经营,推进农业产业化;促进剩余劳动力转移,合理配置资源;依法流转承包经营权,保障用益物权。当前农村土地承包经营权流转的障碍主要表现为法制的不健全和农民观念的滞后。要规制农村土地承包经营权流转应以意思自治为基础,尊重农民意愿,明确土地流转的基本规则,规范土地流转形式和程序,规范流转合同签定和鉴证,规制政府行为,强化政府作为。
Rural land contract and management rights as a new type of usufruct in the "Property Law" is confirmed as a new type of usufruct in the Property Law,and the right can be transferred.it has to flow characteristics.Rural land contracting right and the value can be defined as: the development of appropriate scale,promote agricultural industrialization;for surplus labor,the rational allocation of resources;according to management rights transfer contracts to protect the usufruct.The current rural land contracting right and the main obstacles to the performance of the legal system is not perfect and farmers the concept of hysteresis.To regulate rural land contracting right to autonomy should be based on respect for the wishes of farmers,land transfer clearly the basic rules,norms and procedures for land transfer form,signed the contract specification and verification flow,regulate government actions,and strengthen the government as aduty.
