摘要
租赁权是承租人享有的一种用益物权,抵押权是保护抵押权人利益的一种担保物权,由于两种权利在性质上是兼容的,所以就会发生同一标的物上既存在抵押权又存在租赁权的情形。两种权利并存的情况有时会损害抵押权,使抵押权人不能及时、充分地实现其权利,有时也会使承租人的权利受到侵害。因此,应在立法中修改导致抵押权与租赁权冲突的法律规定,在实践中抵押权人应采取措施防范租赁权的对抗风险。
Leasehold is one kind of usufructuary rights which the tenant enjoys. The mortgage is a real right for security that can protect the mortgagee's benefit. These two rights are compatible in the nature. So these two rights can exist on the identical subject matter. Coexistence of two rights sometimes can harm the mortgage, and sometimes can cause tenant's right to receive the violation. The author puts forward suggestions from maintaining the mortgagee's legitimate interests.
